Terms of Service

Welcome to HomeFault. These Terms of Service ("Terms") govern your access to and use of the HomeFault website, platform, APIs, and related services ("Services") provided by HomeFault, LLC ("HomeFault," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree, please do not use the Services.

1. Description of Services

HomeFault uses artificial intelligence and other automated processes to analyze home inspection reports and related property condition documentation ("Submitted Materials"). Our Services generate structured analyses, summaries, cost estimates, risk assessments, condition reports, and related insights ("Output").

HomeFault is an analysis and decision-support tool for real estate investors. Output is for informational purposes only and does not constitute professional advice, appraisal services, or a substitute for licensed home inspection.

2. Eligibility & Authority

By using the Services, you represent and warrant that:

  • You are at least 18 years old;
  • You have legal authority to bind any organization you represent;
  • You have all rights necessary to provide HomeFault with Submitted Materials, including inspection reports and property information;
  • Your submission of data complies with applicable laws, including privacy laws, and does not violate any agreements with property owners, sellers, or third parties; and
  • You understand that Output is for informational purposes and all investment decisions remain solely your responsibility.

3. License to Use Submitted Materials

By submitting any materials to HomeFault, you grant HomeFault a non-exclusive, worldwide, royalty-free, transferable, sublicensable, perpetual, and irrevocable license to:

  • access, store, reproduce, process, and analyze Submitted Materials;
  • extract structured data, component-level condition information, defect classifications, cost estimates, system ages, and property characteristics;
  • de-identify, pseudonymize, normalize, hash, or otherwise transform Submitted Materials;
  • generate Output and provide it to you or your authorized users;
  • create derivative works, statistical models, predictive analytics, or benchmark datasets based on Submitted Materials;
  • aggregate data across properties, markets, and time periods;
  • use Submitted Materials internally to improve the Services, train AI models, and develop new features; and
  • incorporate insights from Submitted Materials into commercial products and data offerings.

This license continues for as long as HomeFault retains Submitted Materials or Derived Data in accordance with these Terms.

4. Property Identifiers

Submitted Materials may include property addresses, parcel numbers, geographic coordinates, ZIP codes, or other location-based identifiers ("Property Identifiers"). You authorize HomeFault to:

  • store and process Property Identifiers for analysis and reporting;
  • normalize Property Identifiers into parcel numbers, hashed values, geographic identifiers, or other standardized formats;
  • link multiple inspection reports, condition assessments, or events to the same property over time;
  • build longitudinal property histories, component-level condition timelines, and system degradation models;
  • use Property Identifiers internally to support predictive analytics, risk scoring, market analysis, and AI model training; and
  • retain and use de-identified or transformed versions of Property Identifiers in aggregated datasets, market intelligence products, and commercial offerings.

HomeFault will not disclose raw street addresses or personally identifiable information (PII) in external datasets without your explicit authorization.

5. Derived Data

HomeFault may permanently retain, store, analyze, use, license, resell, sublicense, and create derivative works from de-identified, anonymized, or aggregated data derived from Submitted Materials ("Derived Data"), including but not limited to:

  • Component identifications (HVAC systems, roofs, water heaters, appliances, etc.)
  • Condition ratings and defect classifications
  • System ages and estimated remaining lifespans
  • Repair priority levels (immediate, short-term, long-term)
  • Cost estimate ranges and repair budgets
  • Safety issues and code violations
  • Failure patterns and root cause classifications
  • Geographic, temporal, and statistical models
  • Property risk scores and investment risk assessments
  • Market-level condition benchmarks and component lifespan data
  • Predictive models for component failures, capital expenditure forecasting, and property valuation

Derived Data will not include homeowner names, phone numbers, email addresses, full street addresses (other than city/state/ZIP), or other PII as defined by applicable privacy laws.

HomeFault owns all rights, title, and interest in Derived Data. You acknowledge that HomeFault's long-term business model includes aggregating property condition intelligence and licensing Derived Data to third parties, including but not limited to insurance companies, mortgage lenders, real estate platforms, property technology companies, and institutional investors.

6. Prohibited Uses

You agree not to:

  • Upload materials you are not authorized to provide;
  • Upload inspection reports for properties you do not have a legitimate interest in analyzing;
  • Upload unnecessary PII or sensitive personal information beyond what is contained in standard inspection reports;
  • Violate any law, regulation, or third-party agreement;
  • Misuse the Services for fraudulent, deceptive, or harmful purposes;
  • Use the Services to unlawfully discriminate in housing decisions;
  • Reverse engineer, decompile, or attempt to extract underlying AI models or algorithms;
  • Resell or redistribute Output without HomeFault's prior written consent; or
  • Use Output as the sole basis for legally binding, safety-critical, or irreversible investment decisions.

7. No Guarantee of Accuracy; Informational Use Only

Output is generated using automated AI systems and may contain errors, omissions, or inaccuracies.

HomeFault does not guarantee:

  • Accuracy or completeness of cost estimates;
  • Correctness of defect classifications or risk assessments;
  • Suitability of Output for any particular investment decision;
  • That Output reflects current property conditions (analysis is based on submitted inspection reports only); or
  • Compliance with local building codes, regulations, or market conditions.

All investment decisions, property purchases, repair negotiations, and financial commitments made using Output are solely your responsibility. You should always:

  • Obtain professional inspections from licensed inspectors;
  • Get contractor bids for actual repair costs;
  • Consult with real estate professionals, attorneys, and financial advisors; and
  • Conduct your own due diligence before making investment decisions.

8. Security

HomeFault uses commercially reasonable administrative, technical, and physical security measures to protect Submitted Materials and Output. However, no method of transmission over the internet or electronic storage is 100% secure. You acknowledge and accept this inherent risk.

9. Confidentiality

HomeFault will not share your raw Submitted Materials with third parties except:

  • As necessary to provide the Services (e.g., cloud infrastructure providers);
  • With your explicit authorization;
  • To comply with legal obligations, court orders, or governmental requests;
  • To protect HomeFault's rights, property, or safety; or
  • In connection with a merger, acquisition, or sale of assets (with confidentiality obligations).

Derived Data is not considered Submitted Materials and may be used, licensed, and distributed by HomeFault without restriction, provided it is properly de-identified and does not contain PII.

10. Intellectual Property

All intellectual property in the Services, including software, algorithms, AI models, analytics, user interfaces, and Derived Data, belongs exclusively to HomeFault.

You retain ownership of your original Submitted Materials, subject to the licenses granted in these Terms.

11. Payment & Subscriptions

Pay-As-You-Go: One-time payments for individual reports are non-refundable once Output is delivered, except as described in Section 12 (Refund Policy).

Unlimited Monthly Subscription: Billed monthly. You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial months.

12. Refund Policy

If HomeFault is unable to process your Submitted Materials or generate Output due to technical errors or file incompatibility, you will receive a full refund.

If you are not satisfied with the quality of Output, you may request a refund within 48 hours of report delivery by contacting support@homefault.com. Refund requests will be reviewed on a case-by-case basis.

No refunds will be issued for:

  • Disagreement with cost estimates, risk scores, or analytical conclusions;
  • User error (e.g., uploading wrong file, incomplete inspection report); or
  • Subscription cancellations after the current billing period has started.

13. Termination

You may stop using the Services at any time. HomeFault may suspend or terminate your access if you:

  • Violate these Terms;
  • Engage in fraudulent or abusive behavior;
  • Pose a security or legal risk to the platform; or
  • Fail to pay amounts owed.

Upon termination, HomeFault may retain Derived Data permanently in accordance with Section 5.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • HOMEFAULT IS NOT LIABLE FOR LOST PROFITS, LOST REVENUE, LOST INVESTMENT OPPORTUNITIES, PROPERTY LOSSES, CONSEQUENTIAL DAMAGES, INDIRECT DAMAGES, OR PUNITIVE DAMAGES.
  • HOMEFAULT'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID TO HOMEFAULT IN THE PRIOR 12 MONTHS, OR $100, WHICHEVER IS GREATER.

15. Indemnification

You agree to indemnify, defend, and hold harmless HomeFault, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your submission of unauthorized, inaccurate, or unlawful data;
  • Your reliance on Output for investment decisions;
  • Your violation of these Terms or applicable law; or
  • Your infringement of third-party rights.

16. Dispute Resolution; Arbitration

Any dispute arising from these Terms or the Services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations or data breaches.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

17. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any disputes not subject to arbitration will be resolved exclusively in the state or federal courts located in Michigan, and you consent to personal jurisdiction in those courts.

18. Changes to Terms

HomeFault may modify these Terms at any time by posting the updated Terms on the website with a new "Last Updated" date. Continued use of the Services after changes are posted constitutes acceptance of the modified Terms.

We encourage you to review these Terms periodically.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HomeFault regarding the Services and supersede all prior agreements, representations, or understandings.
